Introduction and acceptance of the agreement

Terms of service

This service agreement (the Agreement) governs the provision of services by the online service imperial-print.com (the Service). This Agreement is a public contract under Article 633 of the Civil Code of Ukraine. A person submitting artwork for printing (the Buyer) accepts the Agreement in full by completing and submitting the registration form on the website.

If the Buyer does not agree with any provision of this Agreement or with the Agreement as a whole, the Buyer must not register or purchase services.

Use of the Service means that the Buyer accepts the rules, time limits, restrictions and other cooperation terms stated in this document at the time of acceptance.

The service provider and seller on imperial-print.com is sole proprietor Dari Taisa Mykolaivna, tax number 1890916825, not registered for VAT, registered address: 4 Martyrosiana Street, apt. 45, Kyiv 03186, Ukraine.

By accepting this Agreement, the Buyer (the User) confirms that:

a) the User is an adult with full legal capacity and may enter into transactions at their own discretion;
b) the User acts genuinely to obtain the Service, without malicious or fraudulent intent, attempts to disrupt the Service, gain unauthorised access to intellectual property or trade secrets, misuse the Service or discredit the Service or other users;
c) to the User’s knowledge, their actions do not infringe third-party intellectual property rights;
d) the contact information supplied to the Service is accurate, complete and current;
e) the User has the legal right to make payments to the Service;
f) the User has the legal right to receive any payments from the Service.

The Service operates under Ukrainian law and applicable international legal rules effective in Ukraine.

1. SERVICES FOR BUYERS

1.1. The Service provides Buyers with professional printing services and produces printed products.

1.2. Every printed item is made to the Buyer’s individual order. Correctly produced personalised print cannot be returned or exchanged merely because its colour or size does not meet subjective expectations, in accordance with applicable Ukrainian consumer service rules.

1.3. Buyers should review the Service’s reference and artwork-preparation materials before ordering to reduce discrepancies between expectations and a correctly produced item.

1.4. The Service uses modern technology, equipment and materials. Manufacturing defects may nevertheless occur. A defective unused item may be replaced or refunded if a claim is submitted within three days of receipt and the defect arose before dispatch. The Service may arrange an expert assessment to establish the cause.

1.5. The Buyer is responsible for the content and correctness of artwork submitted for production. The Service is not required to replace or refund an item where a difference results from the Buyer’s file or instructions. The Service may nevertheless resolve a substantiated claim at its discretion.

1.6. If the Buyer’s absence or inaction prevents delivery or completion of the service, the Service may require the Buyer to cover all or part of the cost of repeating the service, including delivery, packaging and production.

1.7. Copyright in original images supplied by the Buyer remains with the Buyer.

1.8. The Buyer agrees to receive operational notices about services, working hours and other relevant updates by email, SMS or other contact methods. The Buyer may unsubscribe where applicable.

1.9. The Service may use paper of a higher grammage than specified without separate notice.

1.10. Paper grammage does not directly determine thickness, stiffness, bulk or whiteness. Correctly printed items are not returnable solely because these subjective paper characteristics differ from expectations.

1.11. The finished size may vary by up to ±3 mm.

1.12. We strongly advise against borders close to trim lines because perfect symmetry cannot be guaranteed.

1.13. An order may be cancelled only while the website still offers that option and before materials have been consumed. Three-hour production orders cannot be cancelled.

2. INFORMATION AND ITS USE

2.1. Users must provide accurate information needed to deliver the requested services. The Service does not sell or disclose user information to third parties except where Ukrainian law expressly requires it.

2.2. Inaccurate or missing contact information may delay service until correct details are received.

3. LIMITATION OF LIABILITY

3.1. The Service acts in the interests of Buyers and takes lawful and ethical steps to resolve disputes and protect legitimate user interests.

3.2. Services are provided on an as-available basis. Undetected technical faults, human factors or force-majeure events such as war, fire, flood or civil unrest may prevent or delay performance.

3.3. Where obligations cannot be performed for the reasons above, excluding force majeure, liability is limited to the amount paid by the Buyer for the affected service.

3.4. The Service’s financial liability may not exceed the amount received for the relevant service.

3.5. The Service is not liable for force-majeure events.

3.6. The Service may stop serving a Buyer in the following cases:

3.6.1. Repeated breaches of generally accepted online conduct, including spam, hate content, promotion of hard drugs or destructive ideologies;

3.6.2. Malicious actions, including hacking or attacks intended to disrupt or discredit the Service;

3.6.3. A court order or another case provided by applicable law.

4. DEFECTS, CLAIMS AND ISSUES

Most issues can be resolved. Submit a claim for the order or contact your manager.

Important:

4.1. Submit a claim from My account > Orders by opening the relevant order and selecting the defect-reporting option.

4.2. Claims are reviewed no later than 14 days after the products are received.

4.3. Claims are not reviewed where:

4.3.1. The product has been used;

4.3.2. The parcel’s outer packaging was damaged in transit and the issue was not recorded with the carrier;

4.3.3. The packaging needed to assess transport damage is missing;

4.3.4. The defect resulted from the Buyer’s actions, misuse or improper storage.

4.4. A production delay of 1–3 working days may occur. Delivery costs are not reimbursed solely because of such delay.

4.5. If finishing is partly or wholly omitted, recalculation or compensation is based on the value of that finishing in the run.

4.6. If the delivered quantity is incorrect, recalculation or compensation is based on the unit value in the run.

5. AMENDMENTS

This Agreement may be amended or supplemented.
